With California passing Senate Bill 9 in early September 2021, homeowners are getting more keen on building on their homes. Senate Bill 9 allows homeowners to rent out their home for up to 120 days at a time without having it considered their primary residence. This bill is meant to help with the increasing demand for home rentals in the city of Los Angeles. A Few Things to Consider Before Building ADUs


Encouraging the establishment of accessory dwelling units (ADUs) in zones that allow single-family and multifamily uses, as provided for in Government Code Section 65852.150, has been found and declared by the California Legislature to provide additional rental housing and to be an important component in meeting California's housing needs.


ADUs are not subject to local land-use restrictions, which is a good thing. However, rather than imposing minimum lot size requirements, these standards should not include them. Furthermore, lot coverage rules may not obstruct the establishment of a statewide exemption ADU (800 square feet ADU with a height limitation of 16 feet and 4 feet side and rear yard setbacks).


If lot coverage standards prohibit the construction of an ADU, authorities should grant an automatic exception or exemption to acceptable building criteria such as lot coverage, floor area, and open space requirements.


Local governments might continue to enforce building and safety regulations, as well as consider design, landscaping, and other criteria in order to make the project more compatible.


Remember, your local HOA (Homeowners Association) can never prohibit the construction of ADU within your own property.


What is an ADU and what can be built on my existing property?


An ADU is a self-contained dwelling that may be used as an extra room or as part of the primary structure. For one or more persons, it offers completely independent living facilities.


The California Department of Housing and Community Development's ADU Handbook lists a number of ADU variations which homeowners can build on their existing property such as the following:

  • Detached: The space is kept separate from the main structure.

  • Attached: The structure is connected to the main building.

  • Converted Existing Space: A freestanding structure constructed after the property has been used as a primary residence (that is, not attached to or part of another building) for at least one year may be used to convert a primary residence into an independent living unit.

  • Junior Accessory Dwelling Unit (JADU): A conversion can be a type of change in the use of an existing space. It is not new construction and it happens when you add on to or modify your house.
